Is your company video legal?
Your video has been produced. Hopefully it looks great, showing and saying the things your prospects will be interested in, but is it legal?

There's more to professional and amateur productions than filming and editing. They must all conform to Advertising Standards (ASA), Performing and Mechanical Rights (PRS) regulations. For the purpose of this article we'll look at video production that is used for marketing and sales purposes, highlighting four top areas that are prone to abuse.

Vlogs and blogs can be produced by an independent source but when produced by the company whose service or product is featured, by its agent or anyone who will gain from its promotion, it must be quickly clear that it contains marketing material or an advert. It must not mislead the viewer into thinking it is independent.

Testimonials and Recommendations
The content must be accurate, true and have the ability to be checked. There are also requirements regarding how the content is created and any interest the donor may have regarding the company, service or product being recommended.

If commercially produced music, video, film, TV footage or graphic design is used, a copyright fee must almost certainly be paid to writers, performers, producers and distributors. These people have professional skills and it's the way they earn their livings. Not paying is theft and that's not good for your reputation, either.

Filming adults often requires their personal consent. The rules for private and public filming vary according to situation and location. In the case of young people, the age of consent, parental/guardian approval is 16 and professional guidelines apply to 17/18 year olds.

Whilst few set out with deliberate intent to break the law, it happens. Buyer beware - not all producers will be familiar with the regulations so what might initially appear as an innocent video might actually be a potential legal minefield that could and sometimes does backfire.
